Equitable Distribution Process- Identification of Property

- Partner’s property before marriage
- And the gifts received during the marriage
Everything else is treated as marital property. Marital property is defined as property acquired by one or both spouses during the marriage and possessed by both spouses before to or on the date of separation. Though! marital property is subject to the equitable distribution process & separate property is not dispersed in a fair way. All separate property will be handed to the spouse who owns it when the divorce is finalized.
The equal share statute assumes that all property acquired by one or both spouses during the marriage is marital property. If a spouse desires to contest the presumption that property is separate property, he or she must produce evidence.
Equitable Distribution Property Valuation and Distribution
The court will then determine the fair market value of each item considered marital property. To determine the value of property, courts frequently employ appraisers or other appropriate specialists. The fair market value of an item is the amount that another interested buyer would pay a willing seller to buy it. Finally, the court divides the property in a way that is equitable or fair to both parties. Unless the court concludes that equal distribution would be inequitable, equal distribution is necessary. A factor test is used by courts when deciding whether or not to divide property evenly.
