Who had access to the space? Who owned the bag or container? Were several people nearby? Is there anything connecting one specific person to the substance?

Those details can matter just as much as where the drugs were found.

There is no single fact that automatically proves someone planned to deliver drugs.

That evidence may include:

  • The amount of the substance
  • How it was packaged
  • Cash found during the investigation
  • Scales or packaging materials
  • Text messages or other communications
  • Statements made to police
  • The location where the drugs were found
  • Other items recovered during a search

The important point is that these facts can be interpreted differently.

Cash may have an innocent explanation. Packaging materials may not mean what police say they mean. A message can look very different when it is read in context.

Where was the substance found? Who had access to it? What else did police recover? What evidence is being used to argue intent? Was the search lawful?
